Last updated: March 27, 2026. This Terms of Service and User Agreement (the "Agreement") constitutes a legally binding contract between EcoCharge Energy Network Inc. ("EcoCharge," "we," "us," or "our") and any individual, property owner, Strata Corporation, or authorized facility manager ("User" or "Host") accepting the deployment of EcoCharge EV charging hardware ("Hardware") and associated services. By ordering, activating, or allowing the installation of the Hardware, you agree to be bound by this Agreement.
EcoCharge provides the Hardware under a Zero-CapEx model. Legal title and ownership of the Hardware remain exclusively with EcoCharge throughout the term. The User is granted a revocable, non-transferable, non-exclusive license to use the Hardware solely in conjunction with the EcoCharge network. The User shall not permit any lien, charge, or encumbrance to be placed upon the Hardware. The Hardware is not a fixture of the real property and may be removed by EcoCharge upon breach of this Agreement.
Single-Family Residential (SFR) Users:
Commercial Hosts (Multi-Family, Strata, Commercial): Hardware is provided without a deposit, subject to EcoCharge's qualification criteria. Commercial Hosts must maintain participation for an initial term of 120 months from hardware activation. The Commercial Host represents and warrants full legal authority to permit installation, including all required strata approvals where applicable.
SFR Termination & Hardware Return: SFR Users may terminate at any time with 30 days' written notice. Prior to 1,500 kWh: the User arranges disconnection by a licensed electrician at the User's cost, returns the Hardware, and receives the full $199 deposit back within 30 days of confirmed receipt. After 1,500 kWh (deposit already returned): no further payment is owed by either party upon hardware return. Damaged hardware may result in withheld deposit or repair charges. Accrued per-kWh rebates are paid within 60 days of confirmed hardware return.
Upon activation of the Hardware, the User irrevocably and exclusively assigns to EcoCharge 100% of all present and future environmental attributes, carbon credits, and GHG reduction rights associated with the Hardware — including BC LCFS credits and Federal CFR credits. The User waives any right to claim, monetize, or register these attributes. Any attempt to do so constitutes a material breach.
The User must supply continuous electrical power and maintain a 24/7 stable Wi-Fi or cellular connection to the Hardware at their own expense. If SFR Hardware remains offline for more than 30 consecutive days, EcoCharge may suspend rebates or invoice the User for the Hardware's retail MSRP. Commercial Hosts who unplug Hardware, restrict backend access, alter the OCPP URL, or terminate without cause prior to the 120-month term are liable for liquidated damages: $1,500 CAD per port plus estimated lost Environmental Attribute revenue for the remainder of the term.
EcoCharge provides the Hardware "AS IS". The User is solely responsible for engaging a licensed electrical contractor for installation. EcoCharge is not a licensed electrical contractor. The User indemnifies EcoCharge against all claims, damages, fires, electrical overloads, personal injuries, or property damage arising from installation or use.
EcoCharge reserves the right to alter, reduce, or terminate any commercial terms without prior notice if there are material changes to the CFR or LCFS frameworks, or a significant depreciation in carbon credit market value. The SFR per-kWh rebate is subject to modification and termination as set out in Section 2.
This Agreement is governed by the laws of British Columbia and the federal laws of Canada. Disputes are resolved by binding arbitration administered by the Vancouver International Arbitration Centre (VanIAC) — single arbitrator, seated in Vancouver, conducted in English. Each party irrevocably waives the right to participate in any class action or representative proceeding. EcoCharge reserves the right to seek emergency injunctive relief from any court to prevent irreparable harm.
EcoCharge's maximum aggregate liability shall not exceed the greater of $500 CAD or total amounts paid by the User in the 12 months preceding the claim. EcoCharge shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. This does not limit liability for fraud, gross negligence, or wilful misconduct.
EcoCharge is not liable for failures or delays caused by circumstances beyond its reasonable control, including acts of God, pandemic, governmental action, changes in law (including LCFS/CFR changes), supply chain disruptions, cyberattacks, or labour disputes. If a Force Majeure Event continues for more than 90 consecutive days, EcoCharge may terminate affected deployments without liability.
EcoCharge may assign this Agreement without consent in connection with a merger, acquisition, or sale. Users may not assign without EcoCharge's written consent. Upon a bona fide property sale, the incoming owner may assume the Agreement with 30 days' notice and a written assumption agreement.
If any provision is found unenforceable, it shall be severed to the minimum extent necessary. This Agreement, together with any written schedules or addenda, constitutes the entire agreement and supersedes all prior negotiations. No amendment is binding unless in writing and signed by both parties.

Charging session data used for environmental credit generation is aggregated and anonymized (or pseudonymized) before submission to any government registry, unless direct PII is mandated by CFR/LCFS auditing frameworks. We implement industry-standard administrative, technical, and physical security measures. Our CSMS sub-processors and cloud infrastructure providers may store or process your information on servers outside British Columbia, including in other Canadian provinces and the United States. By using our services, you acknowledge and consent to such cross-border transfers.
Personal information is retained for the duration of your service agreement plus 7 years, as required for carbon credit audit and tax compliance. Charging data may be retained longer for regulatory purposes.
You have the right to access, correct, and withdraw consent for your personal information, subject to applicable legal and regulatory obligations (including the 7-year retention requirement). EcoCharge provides EV charging hardware and a platform for Commercial Hosts to set custom tariffs. EcoCharge makes NO representations, warranties, or guarantees regarding financial return on investment (ROI), utilization rates, EV traffic volume, or revenue. The Host assumes 100% of economic and business risks related to electricity costs, demand charges, tariff decisions, and EV driver adoption. Any ROI calculators or projections in marketing materials are strictly illustrative and do not constitute financial guarantees.
All projections, promotional materials, and representations on this website regarding financial incentives, rebates (including the SFR per-kWh rebate), or potential Commercial Host benefits rely on the BC Low Carbon Fuel Standard (LCFS) and Federal Clean Fuel Regulations (CFR). EcoCharge operates as an infrastructure supply and software management entity. EcoCharge is not a licensed electrical contractor. All hardware is provided "AS IS". It is the User's/Host's sole responsibility to engage a licensed, bonded, and insured electrical contractor for installation. EcoCharge disclaims all liability for property damage, electrical fires, grid overloads, or personal injury resulting from improper installation, inadequate panel capacity, or failure to obtain permits.
Submission of an application and payment of a deposit does not guarantee program acceptance. If your property is found ineligible, your deposit will be refunded in full within 10 business days.
